PROCLAIMING A STATE OF MARTIAL LAW AND SUSPENDING THE PRIVILEGE OF THE WRIT OF HABEAS CORPUS IN THE PROVINCE OF MAGUINDANAO, EXCEPT FOR CERTAIN AREAS

WHEREAS, Proclamation 1946 was issued on 24 November 2009 declaring a state of emergency in the provinces of Maguindanao, Sultan Kudarat and the City of Cotabato for the purpose of preventing and suppressing lawless violence in the aforesaid areas;



WHEREAS, Section 18 , Article VII of the Constitution provides that ” x x x In case of invasion or rebellion, when the public safety so requires it, (the President) may, for a period not exceeding sixty days, suspend the privilege of the writ of habeas corpus or place the Philippines or any part thereof under martial law, x x x “



WHEREAS, R.A. No. 6986 provides that the crime of rebellion or insurrection is committed by rising publicly and taking arms against the Government for the purpose of xxx depriving the Chief Executive or the Legislature, wholly or partially, of any of their powers or prerogatives.”



WHEREAS, heavily armed groups in the province of Maguindanao have established positions to resist government troops, thereby depriving the Executive of its powers and prerogatives to enforce the laws of the land and to maintain public order and safety;



WHEREAS, the condition of peace and order in the province of Maguindanao has deteriorated to the extent that the local judicial system and other government mechanisms in the province are not functioning, thus endangering public safety;



WHEREAS, the Implementing Operational Guidelines of the GRP-MILF Agreement on the General Cessation of Hostilities dated 14 November 1997 provides the following is considered a prohibited act: ” x x x establishment of checkpoints except those necessary for the GRP’s enforcement and maintainance of peace and order; and for the defense and security of the MILF in their identified areas, as jointly determined by the GRP and the MILF, x x x “



NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, by virtue of the powers vested in me by the Constitution and by law, do hereby proclaim as follows:



SECTION 1. There is hereby declared a state of martial law in the province of Maguindanao, except for the identified areas of the Moro Islamic Liberation Front as referred to in the Implementing Operational Guidelines of the GRP-MILF Agreement on the General Cessation of Hostilities.



SECTION 2. The privilege of the writ of habeas corpus shall likewise be suspended in the aforesaid area for the duration of the state of martial law.



DONE in the City of Manila, this 4th day of December in the year of our Lord, Two Thousand and Nine.

Pahunga nimo TS. Hawak na nila (mga Ampatuans) ang Maguindanao. kung wala pa tung martial law, lagmit hangtud karon ga gyera pa kay naka solidify na ang mga Ampatuans sa ila nga private armies. There could have been more blood shed. More than just the 57 massacred. Mo pa abot pa ka nga kani mahitabo usa ka mo declare ug Martial law? Kung ing ana ka maba ang utok sa mga pinoy , na dugay ra unta nang nahimong Komunista nga nasod. Martial Law pre empted a Bloody Rebellion.

Martial Law?

For me martial Law is better..

Why?

1.) Democracy is being abused by its citizen.

2.) Anti-government rally is being misused, that cause to our economic slowdown.

3.) Law is not implemented, and violators never punished.

4.) Political war between political parties.

5.) Corruption on government agencies from top to bottom ( President >senate> congress> governors,

Mayors,Cptn) and the citizen itself.

6.) Private armies and guns are buildup by the power full individual.

7.) etc... etc.. etc..

People of the Philippines wake-up

The Corruption is not just in the office of the government, the citizen of the Philippines itself is corrupt.

We must change our corrupt nature in order to succeed.

Inireport ng isang daily newspaper na sasampahan daw ng kasong
rebellion ang mga Ampatuan, mga pulitikong naghahari sa Maguindanao.

Ano kaya ang nagawang rebellion ng mga Ampatuan? Wala kaming nalalaman.
Hindi rebellion ang massacre na ikinamatay sa kamay umano ng mga
Ampatuan ng 57 katao, na 30 sa kanila ay taga-media. Patungo sila sa
Comelec para mag-file ng certificate of candidacy sa pangalan ni
Mangudadato, mahigpit na kalaban ng mga Ampatuan.

Hinostage sila at dinala sa isang ilang na lugar at doon walang habas na pinagpapatay ng mga kampon umano ni Ampatuan.

Sa madaling salita, hindi estado o pamahalaan ang gustong puksain o
ibagsak ng mga Ampatuan kung sila nga ang utak ng patayan. Ang gusto
nilang ubusin ay ang mga ka*laban sa pulitika, ang mga Mangudadato.

Paano naging rebelyon o banta sa rebelyon ang patayan sa pulitika na
siya namang naging dahilan para isailalim sa Martial Law ang
Maguindanao.

Marami na ang naranasan ng bayan na patayan dahil sa pulitika. Walang
hangad ang mga pulitikong ito na ibagsak ang pamahalaan. Ang gusto
nilang ibagsak ay mga ka*laban sa pulitika.

Hindi maabot ng aking isip kung bakit magbabanta ng rebelyon ang mga
Ampatuan. Mga kaalyado sila ni GMA. Sila ang dahilan kung bakit
nagkaroon ng ma*lawak na dayaan para manalo si Gloria noong nakaraang
halalan.

Malaking gantimpala ang natamo nila kay Pangulong Gloria Arroyo.
Katunayan, ang akala ng mga Ampatuan ay makakaligtas sila sa batas sa
pagpatay ng 57 patungo sa kapitolyo.

Ang mga namatay ay walang armas. Hindi rin sila ka*wal o kawani man
lang ng pamahalaan. Mga supporter sila ni Mangudadato na nag-imbita ng
media at mga babae sa pag-aakalang hindi sila papatayin kung kasama ang
media at mga babae. Pero pinatay silang lahat.

Rebellion ba ang ganu’ng pangyayari? May naging banta ba sa pamahalaan ang nangyaring patayan? Wala.

Ngayon, sasampahan daw ng kasong rebellion ang mga Ampatuan. Ang kanilang kasalanan ay murder. Hindi rebellion.

Marami ang naghihinala na may maitim na balak si Pa*ngulong Arroyo sa
pagdeklara ng Martial Law sa Maguindanao. Baka ito ay umpisa ng maitim
na balak na ilagay sa Martial Law ang buong bansa.

Para bang inihahanda na ni GMA ang bayan sa mangyayaring rebelyon kahit hindi naman ito nangyari sa Maguindanao.

Marami tayong kapatid na Muslim sa Metro Manila at iba pang bayan sa
Luzon. Sino sa atin ang makapagsasabi na hindi puwedeng manggulo ang
mga Muslim na ito na hindi sa Mindanao nakatira? Walang makapagsasabi.

Kung ayaw man nila na sumali sa gulo dahil ang mga Muslim na ito ay mga
Maranaw na masipag maghanapbuhay, hindi pa puwedeng sa gobyerno mismo
ni Arroyo ang gumagawa ng gulo at sisihin ang mga Muslim.

Baka sa pagsabog ng mga gusali ng gobyerno ay Muslim ang sisihin.

Lalabas na lumalaki ang gulo sa bayan at may bantang rebelyon. Kung ito
ang mangyari, puwedeng ilagay ni GMA ang buong bansa sa Martial Law.

Ito ang maitim na balak ni Gloria para manatili sa poder bagaman tiyak na hawak siya sa leeg ng militar.

Kung ito ay magkatotoo, hindi matutuloy ang eleksyon. Ang matutuloy ay
ang pagpapahaba ng kanyang poder bagaman hindi siya halal ng tao.
Tiyak na may magsasampa sa Korte Suprema para salu*ngatin ang Martial Law sa Maguindanao.

Wala akong hinala na papayag ang Korte Suprema. Pero kung pumayag,
tapos na tayong lahat. Martial Law nga ang ibaba ni GMA sa buong bayan.
